Limited Container Condition Warranty

1. What this warranty covers

During the applicable warranty period, American Containers LLC warrants to the original purchaser that, under normal stationary storage use, the container will remain substantially functional for the condition classification identified on the invoice or sales documents.

Subject to the terms and exclusions below, covered conditions may include holes or perforations in the roof or exterior walls that permit direct water intrusion; significant floor defects that materially impair normal use; significant door or locking-gear defects that prevent the doors from reasonably opening or closing; and other significant structural defects that prevent the container from substantially meeting the functional condition in which it was sold.

This warranty does not guarantee a container will remain completely free from condensation, humidity, or other naturally occurring interior moisture.

2. Delivery acceptance and final sale

The customer is provided a reasonable opportunity to inspect the container at delivery. Any wrong size or type, readily observable damage, or other visible delivery discrepancy should be reported to American Containers LLC within 48 hours of delivery.

After delivery and acceptance, all sales are final except when American Containers LLC expressly agrees otherwise in writing or applicable law requires otherwise.

This Limited Container Condition Warranty is not a return policy, satisfaction guarantee, trial period, or money-back guarantee. A warranty claim does not, by itself, give the customer the right to return the container, cancel the sale, receive a refund, or demand a replacement container.

3. Used and One-Trip container appearance

Wind and Watertight and Cargo Worthy containers are used shipping containers. Dents, dings, scratches, surface rust, paint wear, discoloration, markings, welds, previous repairs or patches, floor staining, minor door stiffness, and other cosmetic imperfections consistent with the stated condition are normal and are not warranty defects.

One-Trip containers may also have minor scratches, scuffs, dents, surface marks, and paint imperfections from manufacturing, handling, and transportation. Cosmetic appearance, color, age, manufacturer, and normal wear are not covered unless American Containers LLC determines the condition materially prevents the container from meeting its sold functional classification.

4. Placement and site conditions

The customer is responsible for providing and maintaining a reasonably level, stable, adequately drained, and properly supported site. Delivery or placement by American Containers LLC does not guarantee the long-term condition of the customer’s soil, foundation, blocking, or support system.

Conditions caused or contributed to by uneven or improper support, unstable ground, settling, erosion, shifting, twisting, racking, standing water, or later changes to the site are not covered. Door operation can be affected by support and site conditions and is not covered when the cause is improper placement, settling, or movement.

5. Additional exclusions

This warranty does not cover buyer’s remorse, a change of plans, property or permitting issues, inability to use the container for an intended project, or simply no longer wanting or needing the container.

It also does not cover damage or conditions caused or contributed to after delivery by relocation or transportation; lifting, dragging, or improper handling; collision or impact; vehicles, machinery, or equipment; cutting, drilling, welding, or other modification; installation of windows, doors, vents, electrical, plumbing, insulation, HVAC, or other improvements; fire, flooding, wind, hail, tornadoes, falling objects, severe weather, vandalism, animals, pests, chemicals, corrosive materials, or other external events; abuse, misuse, neglect, improper maintenance, normal wear, cosmetic deterioration, or unauthorized repair.

American Containers LLC does not warrant that a container is suitable for a particular project, occupancy, code, engineering, permitting, or specialized use beyond rights that applicable law does not permit to be excluded or limited.

6. How to make a claim

A claim must be reported promptly after discovery and within the applicable warranty period. The customer must give American Containers LLC a reasonable opportunity to inspect, investigate, and evaluate the claimed condition before repairs, modifications, or other corrective work begins.

American Containers LLC may require the customer’s name and purchase information, container identification number, delivery address, a description of the issue, photographs or video, photographs of the entire container and its placement, photographs of the ground, blocks, or supports, and other information reasonably needed to determine the nature and cause of the condition.

Failure to provide reasonably requested information or access may prevent a coverage determination. A condition is not presumed to have existed at delivery solely because it is reported during the warranty period.

7. Coverage determination

American Containers LLC will evaluate each claim using the container’s sold condition classification, delivery and inspection records, available photographs or video, elapsed time, site and support conditions, subsequent movement or modification, customer use, weather or external damage, and other relevant evidence.

American Containers LLC retains the right, acting reasonably and subject to applicable law, to determine whether a claimed condition is covered. The existence of a problem during the warranty period does not automatically establish warranty coverage.

8. Corrective remedies

If American Containers LLC determines that a condition is covered, American Containers LLC will select the appropriate corrective remedy, subject to applicable law. Depending on the circumstances, the remedy may include adjustment, repair, providing repair materials, arranging for repair, reimbursement of a reasonable repair expense specifically authorized in writing in advance, component replacement, container replacement when American Containers LLC determines replacement is appropriate, or another reasonable corrective measure.

A repairable covered condition does not automatically entitle the customer to a replacement container or refund. The customer does not have the unilateral right to select the remedy.

Repairs or expenses incurred without prior written authorization from American Containers LLC are not eligible for reimbursement. Warranty coverage does not automatically include transportation, relocation, lifting, crane service, site preparation, or access costs unless American Containers LLC authorizes them in writing or applicable law requires otherwise.

9. Ownership and transfer

This warranty applies only to the original purchaser and the specific container identified in the applicable invoice or sales documentation. It begins on the original delivery date and is non-transferable unless American Containers LLC expressly agrees otherwise in writing.

10. Rights preserved

This warranty states the terms of the American Containers LLC Limited Container Condition Warranty. Nothing in it is intended to waive, disclaim, limit, or restrict any right or remedy that cannot legally be waived, disclaimed, limited, or restricted under applicable law.
